Taxes & costs when a non-resident sells in Spain

These are the main figures to plan for. We calculate your exact net amount during the free valuation — no surprises.

3% retention: the buyer withholds 3% of the sale price and pays it to the tax office on account of your capital gains tax. If your real gain is lower, you reclaim the difference — we handle the filing.

Capital gains tax: non-residents pay 19% (EU/EEA) on the actual profit (sale price minus purchase price and allowable costs). The 3% retention counts towards this.

Plusvalía municipal: a local tax on the increase in land value, payable to the town hall; the amount depends on the years owned and the cadastral value.

Agency, legal and certificates: our fee (only on completion), plus energy certificate, mortgage cancellation if any, and lawyer/gestoría costs.

Non-resident sellers: frequently asked questions

Do I have to be in Spain to sell my property?
No. You can grant a power of attorney to a trusted lawyer or representative who signs on your behalf at the notary, so you can sell the whole property remotely from your home country.
What is the 3% retention when a non-resident sells?
When a non-resident sells, the buyer is legally required to withhold 3% of the sale price and pay it to the Spanish tax office (Modelo 211) as an advance on your capital gains tax. If your actual gain is smaller, you can reclaim the excess with Modelo 210. We manage this for you.
What taxes do I pay when selling property in Spain as a non-resident?
Mainly capital gains tax (19% for EU/EEA residents on the real profit) and the municipal plusvalía. The 3% retention is offset against the capital gains tax. We calculate your specific case before you commit.
Do I still need a Spanish NIE and bank account to sell?
Yes, you need a valid NIE to complete the sale, and a Spanish bank account makes receiving funds and paying final utilities easier. If yours has lapsed, we help you sort it out.
How do I transfer the sale proceeds to my home country?
Once completed, funds are paid into your account and can be transferred abroad. We can point you to specialist currency providers to get a better exchange rate than a standard bank transfer.
